Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Phabora platform and related services (the "Service") operated by Phabora ("Phabora", "we", "us"). By creating an account or using the Service, you agree to these Terms.

1. The Service

Phabora is a business-to-business software-as-a-service (SaaS) platform for AI-assisted hiring, including candidate management, AI-powered video interviews with automated scoring, and job-description tooling. The Service is delivered digitally and accessed through a web browser.

2. Accounts & eligibility

You must be at least 18 years old and authorized to act on behalf of the organization you register. You are responsible for safeguarding your credentials and for all activity under your account.

3. Subscriptions, billing & payment

Paid plans are sold on a recurring (monthly or annual) subscription basis, with optional usage-based credits for additional AI interviews. Payments are processed by our authorized reseller and Merchant of Record, Paddle.com. Paddle handles the order, billing, invoicing, and applicable taxes. 4. Acceptable use

You agree not to use the Service to:

• break any applicable law or third-party right;
• upload unlawful, infringing, or malicious content;
• reverse engineer, resell, or abuse the Service or its AI features;
• discriminate unlawfully against candidates or misuse interview data.

5. Customer & candidate data

You retain ownership of the data you submit. Where you upload candidate information, you act as the data controller and Phabora acts as a data processor on your behalf, as described in our Privacy Policy. You are responsible for having a lawful basis to process candidate data.

6. Third-party services

The Service relies on third-party providers (including AI and infrastructure vendors) to deliver features such as transcription, scoring, and video. Their availability is outside our control.

7. Intellectual property

The Service, including its software and design, is owned by Phabora and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription.

8. Disclaimers & limitation of liability

The Service is provided "as is". AI-generated questions, scores, and summaries are decision-support aids and may contain errors; you remain responsible for hiring decisions. To the maximum extent permitted by law, our aggregate liability is limited to the amount you paid in the 12 months preceding the claim.

9. Termination

You may cancel at any time. We may suspend or terminate access for breach of these Terms. On termination, your right to use the Service ends.

10. Governing law & changes

These Terms are governed by the laws of Vietnam. We may update these Terms and will post the revised version here with a new date.
